General Release of Liability

In consideration of being allowed to participate in any way in ELMHURST ATTACK VOLLEYBALL LLC related events and activities, the participant and parent or guardian acknowledges, appreciates, and agrees that:

The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

I understand that by participating in the Program, including, but not limited to, competing or participating recreationally in the sport of volleyball and activities involved in this program is significant and involves the risk of injury.  These injuries can be severe and permanent, and may include, but are not limited to cuts, bruises, strains, joint injuries, bone fractures, back injuries, concussions, paralysis, eye injuries (including permanent loss of vision), other serious bodily injury, and even death. These or similar injuries might result from my own actions or the acts of others or from the unavailability of emergency staff or emergency medical care.

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and

I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS ELMHURST ATTACK VOLLEYBALL LLC, Inc. their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

Medical Release of Liability

I understand that participating in the Program is strenuous and may exacerbate underlying health conditions, including cardiac disease, arrhythmias, circulatory issues, joint and bone problems, and other conditions. I may not be aware of those health conditions, and they may not have been diagnosed.  I agree that I am responsible for determining, in consultation with my health care provider(s), whether I am participating in the Program may involve undue risk to my health due to such known or unknown health conditions. I warrant that I am physically fit and in a condition that will allow me to participate fully in the Program.

I understand and acknowledge that the use of shared sports or exercise equipment, and participation in any Program, involves the risk of transmission of communicable diseases such as MRSA, influenza, and COVID-19, and that these may result in disability and death. My waiver of Claims includes Claims from such injuries and communicable diseases.

In the event of any emergency, I authorize Elmhurst Attack Volleyball officials to secure from any licensed hospital, physician and/or medical personnel any treatment deemed necessary for participants immediate care and agree that I will be responsible for payment of any/all medical services rendered.

Photography Consent

I irrevocably consent to and authorize use of my comments and/or photograph or likeness, thereof, for advertisement, public relations, publicity, or any other non-profit purpose(s) by ELMHURST ATTACK VOLLEYBALL LLC. I agree to waive any present or future claim for compensation or consideration. I also waive my right to inspect or approve the finished product, including written copy that may be created.

Code of Conduct

Any and all participants, both parents/guardians and athletes, engaging in any programming with Elmhurst Attack Volleyball are expected to follow and abide the Code of Conduct during their time in said program:

  • Treat all other participants, coaches, and spectators with respect and dignity at all times.

  • If there are any issues that one feels need to be addressed, they will be communicated to Elmhurst Attack Volleyball leadership via email following a 12-hour ‘cooling-off’ period.

Concussion Protocol
